Controversy in the US: Immigration Part Three

This is a continuation of a previous article and is part three in a series.

The most disturbing policy in the immigration laws concerns those illegal immigrants who have children on United States soil. If an immigrant gives birth to a child in the United States, according to US laws, that child is an automatic American citizens. Although this is great for mother's looking to have American children, it is not great if the mother is not a citizen.

According to US legislation if the child is born here they must stay here and they cannot leave the country without a passport. So, if the mother is detained and is forced to leave the country, the child cannot go with her.

The separation of a mother and child simply because the mother is an illegal immigrant is ridiculous. No one, not an immigrant illegal or legal, or even a true US citizens would want to be separated from their child simply because the child was born a citizen and they were not.

There are so many ways that this issue could be fixed. Allowing the mother's to stay or allowing the child to go with the mother. Either way has it problems. More mothers might come to America to give birth so they can stay without having to go through the proper channels, or mothers might abandon their children so they can live in the United States. This piece of policy is truly the most controversial and sad.

This is a piece of policy that needs to be fixed. Fixing the problem of illegal immigration is hard, it will not be a simple task and it might take way over a few decades before every party is even partially satisfied. Still, how might it be fixed?

The first problem is all of the illegal immigrants already here. Twelve million currently are thought to reside in the United States. That is too many to force out of the country. It would be impossible to generate the manpower needed to find all of them and get them back to their original countries.

The most obvious method would be to legalize as many as possible. The best method would be to instill something similar to a common law marriage. After a certain number of years in the United States, even if that time spent was illegal, allow for citizenship to be appointed. So, a new policy could be implemented to say that after five years of living in the United States a person is allowed to apply for citizenship and achieve it with no strings attached.

In this way, the majority of illegal immigrants would be able to get their citizenship right now and any incoming illegal immigrants would be able to get their own in at least six years. This would probably be one of the easiest ways to reduce the amount of illegal immigrants in the United States and would possibly take the least amount of money.

Still, the most difficult topic has yet to be addressed. What about those peoples that don't want to be United States citizens but just need work? In this case, a Guest Worker's Program is needed. Presidents Bush's proposal was probably the last piece of the puzzle that needed to be implemented to fix the immigration problem. A lot of the people that enter the United States both legally and illegally do not want to be citizens.

They take great pride in their home countries and most likely, once they obtain enough money, will return to them to live. If this is the case then citizenship is not the solution, a Worker's Program is instead. To achieve this, a completely new government program would have to be created.

First, the type of jobs offered would have to be accessed. Is the program going to limited the workers to manual labor jobs are should the program allow more advanced workers like technicians or computer operators to come into the country for work? Most likely it would have to be an all encompassing program, if the government limited the types of jobs available then they would not stop the illegal immigration process from happening. At the same time, the discussion of pay would have to be raised.

At the moment illegal immigrants probably make bellow minimum wage, they are a source of cheap but affective labor. To stop these people from getting under paid the program would probably have to control the amount of money the employers can pay their workers. Once all of this is determine the actual fundamentals of the program would have to be determined. In other words, how would the workers apply?

The current process is much to complicated, it needs to be something easy for anyone to do and probably connected to the other countries government somehow. For example, the worker would need to go to their government for the information and then file the paper work with the particular company they wish to work for. In this way both countries can monitor the people working in the program. At the same time this might give the mother country the ability to collect taxes off of the worker instead of the United States or vice versa. In this way the United States would get the benefit of immigrant workers without the constant debates on taxes and economic standing between countries. With this basic program in place the United States would probably function a lot better and illegal immigration would probably reduce.

Illegal Immigration is a complex and controversial topic. There is, truthfully, no set way to make the controversy fade and their most likely will not be a quick and painless way to solve the problem in the next couple of years. Hopefully, through reform and policy changes the issue will be resolved. Until this time it is important for United States citizens to realize the difficulty faces American Immigrants. Even if they wish to come into the country legally they still face a long and confusing process that is, for the most part, extremely hard to complete. Only with understanding as to why these people immigrate illegally can the American citizen learn to tolerate their presence and hopefully, help them gain their citizenship or worker status. To do this the American citizen must tell the government what they want. They want better immigration policies, easier means of obtaining workers status, and easy to use programs that would allows illegal immigrants to work legally.
